Terms of Use for Chat Wizard

1. Acceptance of Terms

By accessing or using Chat Wizard, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these Terms, please do not use the application.

These Terms apply to your use of the Chat Wizard mobile application, website, and related services.

2. Description of Service

Chat Wizard is an AI-powered language learning application designed to help users practice and improve their English skills.

The service may include features such as:

• Text and voice conversations with an AI tutor
• Pronunciation feedback
• Grammar and vocabulary feedback
• Placement tests and language-level estimates
• Spaced repetition and personalized review
• Learning goals, streaks, and progress tracking
• Subscription-based premium features
• Optional social learning features through Study Circle

Chat Wizard is intended to support language learning. It is not a replacement for professional education, official language certification, legal advice, medical advice, psychological advice, financial advice, or other professional services.

3. User Eligibility

You must be at least 13 years of age to use Chat Wizard.

If you are under the age of majority in your country, state, or region, you must use Chat Wizard with permission and appropriate supervision from a parent or legal guardian where required by law.

By creating an account or using Chat Wizard, you represent and warrant that you meet these eligibility requirements.

We may suspend or terminate accounts if we believe a user does not meet the eligibility requirements.

4. Account Registration and Security

To use certain features of Chat Wizard, you may be required to create an account.

You agree to provide accurate and complete account information and to keep it updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us if you believe your account has been accessed or used without authorization.

You may not sell, transfer, share, or assign your account to another person without our permission.

5. Acceptable Use

You agree to use Chat Wizard only for lawful, appropriate, and educational purposes.

You may not use Chat Wizard to:

• Violate any applicable law or regulation
• Harass, threaten, abuse, impersonate, or harm another person
• Send or attempt to send offensive, hateful, sexually explicit, violent, discriminatory, or otherwise inappropriate content
• Attempt to exploit or harm minors
• Upload, transmit, or distribute malware, spam, or harmful code
• Attempt to gain unauthorized access to Chat Wizard, its systems, other accounts, or related infrastructure
• Interfere with or disrupt the service
• Scrape, copy, harvest, or extract data from the service without permission
• Reverse engineer, decompile, or attempt to derive source code from the application, except where allowed by law
• Use the service to build, train, or improve a competing product without permission
• Abuse promotions, subscriptions, trials, referrals, or social features
• Circumvent usage limits, rate limits, paywalls, security controls, or access restrictions
• Misrepresent your identity or affiliation with any person or organization

We reserve the right to investigate and take action against any use that violates these Terms or harms Chat Wizard, our users, or others.

6. Educational Use and AI-Generated Content

Chat Wizard uses artificial intelligence to generate responses, explanations, feedback, and learning recommendations.

Although we strive to provide useful and accurate educational content, AI-generated content may be inaccurate, incomplete, inappropriate, or unsuitable for your specific needs.

You are responsible for reviewing and verifying any information before relying on it.

Chat Wizard does not guarantee that:

• All AI responses will be correct
• Pronunciation, grammar, vocabulary, or level evaluations will be perfect
• Your language level estimate will match an official certification
• Use of the service will produce any specific educational result
• The service will prepare you for any particular exam, job, interview, or certification

Chat Wizard is a learning aid, not an official language assessment institution.

7. User Content

You may provide content to Chat Wizard, including text messages, voice messages, audio recordings, profile information, usernames, display names, Study Circle interactions, reports, and other information you submit through the service.

You retain ownership of content you submit, subject to the rights granted to Chat Wizard in these Terms.

By submitting content to Chat Wizard, you grant Chat Wizard a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, analyze, display, transmit, and use your content as necessary to:

• Provide the service
• Generate AI responses and learning feedback
• Personalize your learning experience
• Maintain your learning history and progress
• Provide Study Circle features, if enabled
• Improve safety, security, and reliability
• Comply with legal obligations
• Enforce these Terms

You are responsible for the content you submit and must ensure that you have the rights and permissions necessary to submit it.

You may not submit content that is unlawful, harmful, abusive, hateful, sexually explicit, violent, misleading, infringing, or otherwise inappropriate.

8. Study Circle Social Learning Features

Study Circle is an optional social learning feature that allows users to create a public learning username, choose an avatar, add friends, view privacy-safe learning progress, send predefined encouragement signals, and participate in lightweight study challenges.

Study Circle is disabled by default. You must manually enable it before other users can discover your Study Circle profile.

By enabling Study Circle, you understand and agree that certain information may become visible to other users, depending on your actions and settings. This may include:

• Username
• Display name or nickname
• Pet avatar
• Privacy-safe learning status
• General CEFR level
• Streak or goal progress indicators
• Study challenge participation and progress
• Predefined signals you send
• Friend relationship status

Study Circle does not allow other users to search for you by email address.

Study Circle does not include free-form user-to-user messaging in the current version. Social interactions use predefined encouragement signals.

You agree not to misuse Study Circle, including by:

• Harassing, pressuring, or targeting other users
• Creating offensive, misleading, impersonating, or inappropriate usernames or display names
• Sending spam-like signals or repeated unwanted interactions
• Attempting to contact users outside the intended Study Circle features
• Using Study Circle to shame, rank, bully, or pressure others
• Circumventing blocks, mutes, rate limits, or safety controls
• Creating fake accounts or impersonating another person or organization

We may remove or restrict usernames, display names, profiles, signals, challenges, or accounts that violate these Terms or our safety standards.

9. Blocking, Reporting, and Safety Controls

Chat Wizard may provide safety controls such as muting, blocking, reporting, removing friends, and limiting social interactions.

If you block another user, that user may be prevented from sending you friend requests, signals, or challenge invitations.

If you report a user, we may review the report and take appropriate action, which may include warning, restricting, suspending, or terminating an account.

Reporting another user does not guarantee a specific outcome.

We may also take action without prior notice if we believe it is necessary to protect users, prevent abuse, comply with law, or protect the integrity of the service.

10. Subscriptions, Payments, and Premium Features

Chat Wizard may offer paid subscriptions, premium features, usage limits, trials, or other paid services.

Subscriptions and in-app purchases may be processed through third-party platforms such as Apple App Store or Google Play. Your purchase may be subject to the payment terms, refund policies, and subscription rules of the applicable platform.

Subscription availability, pricing, features, limits, and billing periods may vary by country, platform, or promotional offer.

Unless otherwise stated, subscriptions automatically renew unless cancelled before the renewal date through the applicable app store or platform.

You are responsible for managing and cancelling your subscription through the platform where you purchased it.

Chat Wizard may change, add, remove, or limit free or premium features at any time, subject to applicable law and platform rules.

11. Data Collection, Analytics, and Advertising

Chat Wizard collects and processes personal, usage, learning, social, device, analytics, and advertising-related data as described in our Privacy Policy.

This may include the use of third-party technologies for:

• Operating the service
• AI processing
• Speech transcription
• Pronunciation analysis
• Analytics
• Crash reporting
• Push notifications
• Subscription management
• Advertising attribution
• Marketing performance measurement
• Fraud prevention
• Safety and moderation

By using Chat Wizard, you acknowledge and agree that data may be collected, used, and shared as described in our Privacy Policy, which forms an integral part of these Terms.

12. Intellectual Property

Chat Wizard, including its software, design, interfaces, graphics, logos, trademarks, text, audio, visual elements, features, and related materials, is owned by Chat Wizard or its licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, sublicense, publicly display, create derivative works from, or exploit any part of Chat Wizard without prior written permission, except as permitted by these Terms or applicable law.

Using Chat Wizard does not grant you ownership of any intellectual property rights in the service.

13. Feedback and Suggestions

If you provide feedback, ideas, suggestions, bug reports, or feature requests, you grant Chat Wizard the right to use them without restriction or compensation to you.

We may use feedback to improve Chat Wizard, develop new features, or modify existing services.

14. Third-Party Services

Chat Wizard may integrate with or rely on third-party services, including cloud hosting providers, AI providers, speech processing providers, analytics providers, advertising partners, app stores, payment processors, and notification services.

Your use of third-party services may be subject to their own terms and privacy policies.

Chat Wizard is not responsible for third-party services, websites, policies, content, or practices.

15. Service Availability and Modifications

We may modify, suspend, restrict, or discontinue Chat Wizard or any part of the service at any time, with or without notice.

We may also introduce, change, or remove features, usage limits, pricing, subscription plans, AI models, social features, or availability in certain regions.

We are not liable for any modification, suspension, restriction, or discontinuation of the service, except where required by applicable law.

16. Account Suspension and Termination

We may suspend, restrict, or terminate your access to Chat Wizard if we believe that:

• You violated these Terms
• You violated our Privacy Policy or other applicable policies
• Your use creates risk or harm to Chat Wizard, users, or third parties
• Your account is being used for fraud, abuse, spam, harassment, or unlawful activity
• You do not meet eligibility requirements
• We are required to do so by law or platform rules

You may stop using Chat Wizard at any time.

You may request deletion of your account and personal data directly from the Account section in the Chat Wizard app or by contacting us.

Certain provisions of these Terms may continue to apply after account termination, including those related to intellectual property, disclaimers, limitation of liability, data retention, legal compliance, and dispute handling.

17. Disclaimer of Warranties

Chat Wizard is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and uninterrupted operation.

We do not guarantee that:

• The service will always be available, secure, or error-free
• AI-generated content will always be accurate or appropriate
• Learning results will meet your expectations
• Bugs, errors, or defects will be corrected
• The service will be compatible with all devices or operating systems

18. Limitation of Liability

To the maximum extent permitted by law, Chat Wizard and its creators, owners, operators, affiliates, service providers, and licensors shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the service.

This includes damages related to:

• Loss of data
• Loss of profits
• Loss of goodwill
• Service interruption
• AI-generated errors
• Learning outcomes
• Unauthorized access
• Social interactions
• User conduct
• Third-party services

To the maximum extent permitted by law, our total liability for any claim related to the service shall not exceed the amount you paid to Chat Wizard for the service during the three months before the event giving rise to the claim, or USD $50, whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

19. Indemnification

You agree to defend, indemnify, and hold harmless Chat Wizard and its creators, owners, operators, affiliates, service providers, and licensors from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:

• Your use of Chat Wizard
• Your violation of these Terms
• Your violation of any law or third-party right
• Content you submit
• Your misuse of Study Circle or other social features
• Your interactions with other users

20. Changes to These Terms

We may update these Terms from time to time.

Any changes will be posted on this page, and the “Last updated” date will be revised accordingly.

Your continued use of Chat Wizard after changes become effective means that you accept the updated Terms.

If we make material changes, we may provide additional notice, such as through the app, email, or other reasonable means.

21. Governing Law

These Terms are governed by the laws of Mexico, without regard to conflict of law principles.

If you access or use Chat Wizard from outside Mexico, you are responsible for complying with local laws where applicable. Nothing in these Terms limits any consumer protection rights that cannot be waived under the laws of your place of residence.
